These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Nathan Tang ("Developer") governing your use of StackWizard ("the App"). By accessing or using the App, you confirm that you are at least 18 years of age (or the legal gambling age in your jurisdiction, whichever is higher) and have the legal capacity to enter into this agreement.
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download and use StackWizard on Apple devices you own or control, solely for your personal, non-commercial purposes.

StackWizard and its Wallace AI feature are provided for informational and educational purposes only. Hand analysis is generated by artificial intelligence and should not be considered professional poker coaching, financial advice, or a guarantee of results. We make no representations about the accuracy, completeness, or reliability of any analysis provided by the App.
You are solely responsible for your own poker decisions and any financial outcomes resulting from your use of the App. The Developer is not liable for any losses incurred as a result of decisions made based on content within StackWizard.

StackWizard offers the following auto-renewing subscription plans for Pro access:
Both plans include a 7-day free trial for new subscribers. The following terms apply to all subscriptions:
New subscribers are eligible for one 7-day free trial per Apple ID. The free trial automatically converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. The Developer reserves the right to modify or discontinue free trial offers at any time.
All purchases and subscription payments are processed by Apple. Refund requests must be submitted directly to Apple in accordance with their refund policy. The Developer does not have the ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com.
All content within StackWizard, including but not limited to the app design, graphics, text, code, and the Wallace AI feature name, are the intellectual property of Nathan Tang unless otherwise stated. You may not reproduce, distribute, or create derivative works from any content within the App without prior written permission.
Your use of StackWizard is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.
The Developer reserves the right to terminate or suspend your access to StackWizard at any time, with or without cause, and with or without notice. Upon termination, your license to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
StackWizard is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, the Developer disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, in no event shall Nathan Tang be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use StackWizard, even if advised of the possibility of such damages. Some jurisdictions do not allow these exclusions, so they may not apply to you.
These Terms are between you and the Developer only, not with Apple Inc. Apple is not responsible for StackWizard or its content. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms shall govern with respect to App Store-related matters. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The Developer reserves the right to modify these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of StackWizard after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
